Jamie Foxx is attempting to have the lawsuit filed by his accuser of sexual assault regarding an alleged encounter at a rooftop in New York City dismissed.
According to court documents obtained by In Touch, Jamie claimed that his interactions with Jane Doe, the accuser, were consensual.
Jamie’s attorney contended that “[Doe] consented to those acts that [Jamie] was said to have engaged as described in [Doe’s] [lawsuit.”
If “his client engaged in any conduct as alleged” in the case, “such conduct presented no serious risk of physical injury to the accuser,” his attorney continued.
Furthermore, Jamie stated that the woman filed a nearly identical complaint in 2020, but it was dismissed.
He claimed that if the accuser was hurt, his client was not the reason.
“The accuser waived the right to pursue her claims by reason of her own actions and course of conduct,” the attorney continued. Jamie requested the dismissal of the entire claim along with his costs.
In her lawsuit, the accuser stated that in August 2015, she had met Jamie at Catch NYC & Roof.
According to Jane Doe, her buddy asked the actor if he would pose for a picture with her. Doe stated that she thought Jamie was drunk at the time.
She claimed he said things like, “You smell so good,” and “wow, you have a supermodel body.”
Doe claimed in the complaint that Jamie led her to a restricted location on the rooftop of the club where he touched her waist and underneath her clothing, according to her allegations.
The woman claimed that after moving his hands in the direction of her breasts, he inserted his fingers into her anus and vagina. Doe reported that Jamie halted upon seeing her friend turn the corner.
Unspecified damages were sought in the complaint for the alleged pain, suffering, and emotional distress that Jamie had caused.
Doe begged the court to keep her name secret from the public as part of the lawsuits.
Doe stated, “I was sexually assaulted as indicated in the complaint and as a result, I suffered psychological and emotional injuries,” in a declaration filed in the case.
I have already felt a great deal of shock, shame, and disgrace for coming out as a victim of sexual assault, and I don’t want to reveal my identity to the public at this time because of the defendants’ notoriety and celebrity status.
However, in a statement provided by his representative after the lawsuit was filed, Jamie Foxx refuted the allegations.
