After his ex-girlfriend Brittany Moreland sued for full custody of their 18-month-old daughter, Axl July Ivory Wayans, Marlon Wayans has officially filed a response and he is requesting joint custody.
The legal battle for custody
Court documents obtained by People indicated that Wayans responded to Brittany Moreland’s petition submitted in March 2024, requesting complete legal and physical custody of their 18-month-old daughter.
In addition, Wayans signed a voluntary declaration of parenthood in December and filed it.
He also asked for the equitable sharing of the reasonable costs associated with the pregnancy and delivery, as well as legal bills and other costs incurred throughout the custody dispute.
But Moreland claimed to be an “unemployed graduate student” in California in her court filings, and she had already asked Wayans to pay those costs.

Marlon Wayans spoke out about the custody battle during a March interview with The Shade Room, stating,
“All God, all love. The child is not under wraps. The mother has been shared on social media. However, I made the decision to protect the baby’s privacy,” Wayans said.
He continued by saying that he wished to shield Axl from the bad things that come with social networking.
“It’s not anyone’s business. I’d like to keep her calm since social media is harmful and poisonous,” he remarked. Wayans also voiced his displeasure at being treated like a guest in his daughter’s life.
Details of Moreland’s custody and child support requests
Moreland’s court filings state that Axl spends 95% of their time with her and 5% with the other parent.
She has asked Wayans for an extra $2,000 a month for child care so that she can carry on working.
Wayans also addressed Moreland’s demands for child support, stating to The Shade Room that it’s a typical scenario where a decent, devoted, and responsible father provides more than $18,000 a month for a one-year-old child, and an entitled woman feels she deserves more.
Marlon Wayans is the father of two older children: 21-year-old Shawn and 23-year-old Kai, who came out as transgender in November.
Wayans expressed once more how much he wanted to be involved in Axl’s life as a parent. In his petition, he expressed his desire to partake in the joys and responsibilities of raising their daughter.
